Terms and Conditions

1. Definitions

These terms apply to all commissions placed with Sophiya Kloss. Paying the deposit constitutes acceptance of these terms in full.

"Commission" means the work agreed between the artist and the client as set out in the confirmed brief and quote. 

"Sketch" means the initial composition or layout shared for approval before the finished work begins. 

"Working materials" means all sketches, studies, drafts, and working files produced in the course of completing the commission. 

"Finished work" means the completed artwork as delivered.

2. Scope of Work

The commission covers the work described in the agreed brief. Changes to the brief after the deposit has been paid may affect the price and timeline. Any changes must be agreed in writing before work continues.

3. Payment

A deposit of 50% of the agreed fee is due before work begins. The deposit is non-refundable if the client cancels after work has started. The remaining 50% is due before delivery of the finished work. Work is not delivered until payment has been received in full. 

 

For commissions of £750 and above, an alternative payment schedule is available: 50% on agreement, 25% on sketch approval, 25% on delivery. This must be requested at the time of booking.

4. Sketch Approval

A sketch or composition will be shared for approval before the finished work begins. The client has 30 days to confirm the direction or request changes. If no response is received within 30 days, the commission will be treated as paused until the client responds.

5. Revisions

One round of significant revisions is included at the sketch stage. Significant revisions are changes to composition, framing, pose, or likeness. Changes that go beyond the agreed brief, or that amount to a change of direction, are treated as a new scope and quoted separately. Minor adjustments (tone, expression, small refinements) are included throughout the process. No revisions are included after the finished work has been delivered.

6. Cancellation

Cancellation before any work has begun: deposit retained, no further charge. Cancellation after the sketch has been shared: 75% of the total fee is due. Cancellation after the finished work is complete: 100% of the total fee is due. Work is not delivered until payment is made in full.

7. Delivery

Digital commissions are delivered as high-resolution files by email or file transfer. Original physical artworks are delivered by tracked post or courier; postage and packaging costs are additional and agreed at the time of booking. Risk passes to the client on dispatch of physical artworks.

8. Copyright

The artist retains copyright in all work produced, including working materials. Copyright is not transferred to the client at any point. The client is granted a limited, nonexclusive, non-transferable licence to reproduce images of the finished work for personal, non-commercial purposes, provided the artist is credited by name. 

 

Commercial use, including reproduction in advertising, merchandise, or licensed products, requires a separate written agreement and an additional fee. The artist retains the right to display, exhibit, and reproduce the finished work for promotional purposes, including portfolio use, exhibition, and publication.

9. Artificial Intelligence

The finished work, working materials, and all images produced under this commission may not be used to train artificial intelligence models, submitted to any AI dataset, or used as input to any generative AI system. This prohibition applies regardless of whether the material is used in its original form or in altered or derivative form. It is grounded in the artist's rights under the Copyright, Designs and Patents Act 1988.

10. Working Materials

All working materials remain the property of the artist and are not delivered to the client as part of the commission. The artist may produce works that are informed by or related to the commission. The client does not acquire any right to prevent the artist from making other works, including works that are similar in subject, style, or composition.

11. Privacy

Reference photographs and personal information provided by the client are used solely for the purpose of completing the commission and are not shared with third parties. If the commission is a gift or the client would prefer the finished work not to be shared publicly for a period, this should be stated at the time of booking. The artist will agree a timeframe before the work is exhibited or published.

12. Governing law

These terms are governed by the laws of England and Wales. Any dispute arising from a commission is subject to the exclusive jurisdiction of the courts of England and Wales.

Additions & Complexity

Rush Delivery

Delivery in under half the standard turnaround is charged at an additional 25 - 50 % of the total fee. This must be agreed at the start of the commission, not after work has begun. 

Clothing & Detail

Standard clothing is included. If anything with significant pattern or detail is required, 20 - 35% is added and quoted as part of the brief. Please mention it when you enquire. 

Background

An abstract or atmospheric background is included in the base price.
A specific or recognisable setting adds 30 - 50% and is quoted as part of the brief. 

Additional Subjects

A second subject adds 50 - 60% to the base price. Three or more subjects are quoted individually.

AI-assisted commissions.  All work is entirely made by hand. 

Process

1. Send an enquiry with a brief description of the commission and your reference photographs.

2. I'll look at the brief and references and send a quote. We agree the scope, price, and timeline.

3. A 50% deposit secures your place in the queue. No work begins before this.

4. I'll share a sketch or composition for your approval. One round of significant changes is included at this stage.

5. Once you're happy with the direction, work continues through to completion.

6. Final balance is due before delivery. File(s) or original artwork sent on payment.
